10 factual reasons to vote Against Amendment One

After the jump, I've listed 10 concise factual reasons why people should vote AGAINST Amendment One, as well as provided a graphic summary image you are welcome to download and share. These reasons are confined to facts only, so that they can also be shared with people who may be opposed to gay marriage but need to know about the other implications of the bill.

Amendment One: 10 facts you need to know

The proposed amendment to the NC Constitution in its entirety:

"Marriage between one man and one woman is the only domestic legal union that shall be valid or recognized in this state."

Facts about this amendment you should know:

1. This amendment is not needed to prevent gay marriage: there is already an NC law forbidding gay marriage.

2. This amendment bars the state from recognizing any legal domestic union other than marriage, including partnerships between unmarried men and women.

3. Similar laws in other states have been struck down by the courts - meaning NC will face substantial legal costs to defend the amendment if it passes.

4. This amendment would take away legal protections for the children of unmarried people, including healthcare and prescription drug coverage provided though an unmarried parent and child custody, child support and visitation rights.

5. A child could even be taken away from a parent who has taken care of them their entire life if something happens to the other parent.

6. This amendment would take away domestic violence protections for all unmarried people and could lead to the convictions of their abusers being overturned. This has already happened in another state.

7. The amendment would automatically strip health benefits from unmarried people who receive coverage through their partners, including people with severe pre-existing conditions.

8. The amendment would interfere with the right of unmarried couples to visit one another in the hospital and to make emergency medical and financial decisions if one partner is incapacitated. It would also invalidate certain trusts, wills and end-of-life directives.

9. Seniors wanting to keep these legal protections would be forced to marry, which could cause them to lose their pension, health care and Social Security benefits.

10. If passed, it would be one of a handful of times our state constitution has been used to take away rights rather than grant them. You have to go back over a hundred years to find similar instances (notably forbidding interracial marriage and taking away the right to vote from African-Americans.)

I definitely agree with you. This religious spouting is ridiculous. If our land was blessed we would NOT be facing a ever impending downfall of economics and a one world economic government. Hell, I believe that SOME things in the bible are true, but not everything could be translated, some books did not even make it into the bible. It has been edited.

It is hard to know how to address such breathtaking stupidity. I guess my nine years in the military and my two years as an elected official and the hundred thousand I paid in taxes last year don't amount to much in Red America . . . where the people are inbred, god is an asshole, and history is forgotten.

"God" has a path for everyone.

Church teaches that "God"created creates a path for everyone, well since "God" created these human beings, he has created the path of being gay for them.

The pathway is there and he gave you free will. So yes, in a sense. It's a temptation. And i've read some people bashing Christians saying if a nother man lay with another man they are doomed for hell. It just shows how ignorant they are. We don't know, we know that Jesus died on the cross for our sins and threw him is heaven. No one judges but God.

Under god?

You do know that that whole "under god" thing was only instituted by Truman because he feared that red menace, communism for people who don't know what that is. The founding fathers of this nation were a whole lot smarter, they recognized the diversity this nation had and still has more than ever.

Thank you! Drives me nuts that people say that the phrase 'Under God' was how the founding fathers showed how we should all inherently be Christians. And I AM Christian, and believe in total separation of church and state. Otherwise, you are going to see this kind of religious discrimination.

Do you not realize that "under God" was not even in the Constitution. In fact, the founders opposed the institutionalization of religion. They kept the Constitution free of references to God. The document mentions religion only to guarantee that godly belief would never be used as a qualification for holding office.
In addition, the original Pledge of Allegiance—meant as an expression of patriotism, not religious faith—also made no mention of God - not until 1892.

This land is not "under God" or even Goddess or gods. This land is supposed to be free. The Constitution was not founded on religion but on the freedom of religion. Get your facts straight before you start making opinions sound like facts.

You know when

You know when Tea Party Republican Congresswoman Renee Ellmers, Governor Perdue, President Obama, and the NC Libertarian party are all in alignment on an issue like opposing this amendment, there must be some facts behind it.

Fear Uncertainty & Doubt

Could 10 "facts" contain more B.S?? Playing to unreasonable fears, uncertainty and doubt does not make something a fact.. Of course, some of the items listed are actually reasons to support the amendment...

The "10 Facts" is a snapshot

The "10 Facts" is a snapshot summary (for the busy)of a lengthy and scholarly report written by law professors who see serious potential courtroom battles. And what are your credentials for calling them BS? Have you read what legal experts have said. Is it an unreasonable fear that you the tax-payer will fund NC's battles in the courts as we try to determine what the law actually says and means?

No, these are not facts. But we, in fact, have no facts other than that this law puts us in legal-limbo land. Once it's in the Constitution, it is ours to deal with.

And yikes, really, on the last statement? Yikes.

.. and I'd hate to walk around as that person every day. What a horrible world he/she must live in to see others that way. However, sadly for us all, these facts are already being proven as true indeed. An NC defense attorney filed a few weeks ago to have his client released from jail on a domestic abuse charge on the grounds that he was not married to his abuser. As soon as I get some details, I'll post them. But it didn't take long.

Factual? No.

Whether Gays should be married or not, it doesn't matter. This Amendment One, it's crap, there is a law forbidding Gay marriage, this is just to solidify that law to leave no loopholes. However, these are not all factual reasons or facts. Facts are backup by solid proof which I see none stated. If it gets passed and a storm of crap slams into the giant legal fan, the big man in the land will step in. Most states forget that the Supreme Law of the Land is in the Federal government's court. If it turns out bad, it'll be repelled, seeing as most councilors, judges, representatives and the like can be affected by things stated above as well, thus they are most likely not going to happen. So give me solid rock hard proof before you make such blatant claims BLUENC and PROGRESSNC. Legal opinions and people who did not propose the bill are not sources at all. You are using people who are AGAINST the bill, not people who are BI-PARTISAN. Ask the folks who proposed the bill if these are their underlying "Evil" intentions, the answer will be no. Ask 20,000 people on the streets randomly what the intentions of this bill are, near 100% will say nothing to the effect of what is stated above.

If the bible thumpers would actually read back into history (instead of just living with what they where told in school) they would see that the US was actually formed under NO religion. None of the founding fathers except 1 believed in god, and even he agreed that religion had no place in government. Gays aren't hurting no one (except the catcher, had to throw some kind of joke in there) so why are people so stern about taking away their rights? It does say in the bible "do not lay with a man as you lay with a woman, it is detestable" but that is also back in the old testament along with not eating meat on the sabbath, not cutting your sideburns, ect. So it's ok for you to not follow these few rules in the front of the bible and still make it into your heaven, but if these people don't follow this one they're destined for hell? Also, the book was written by men, it says nothing about a woman laying with a woman as she lays with a man, kind of funny when you really think about it, i'm done for now

There is nothing wrong with gay marriage. If so called "God" created every human being, he created them gay. As every Christian says "God has a path for everyone." well that is their path.
Gays aren't hurting anyone. If it's love, it's love.
It does not matter if it is gay marriage, it is still marriage and we all have the right of marriage.

This amendment is a pile of garbage

I hate that right wing extremists have hijacked Christianity. I am Christian, moderate liberal, and see nothing wrong with gay marriage. The Bible spoke more about love, grace, and NOT judging than it did about whether or not gays should marry. This is ridiculous and these manufactured distractions that the government fools us into fighting over would end if people realized what the powers that be are doing to us. They are tricking us all into fighting about gay marriage and abortion so that they can screw us all over behind closed doors and take away all of our freedom.

Where do these "facts" come from?

I would just like to see the legal documentation that states these alleged facts. The actual amendment just states that marriage between one man and one woman is the only legal union. Where does all this other stuff come from??

Our democracy is in peril when we have so many who are unable or unwilling to actually think beyond the range of their bigotry. I've met many people like this commenter who are too lazy to read what legal experts have said on the Amendment, but somehow "know" their own uninformed views are nonetheless correct.

This is the GOP dream come true: ignorant people, crappy schools, a permanent underclass deluded by the Stockholm syndrome.


I don't think you are lazy. Lots of people see the wording at its face value and think, so what would be wrong with this? I think you are asking a smart question--should I view these "10 Facts" as valid or propaganda?

Please, please, please educate yourself on both sides of the issues before you vote. This amendment is not as simple as it seems. We all have the right to our opinion and our vote. But lots of people I have talked to are shocked to realize that this amendment sets up implications they did not expect. This amendment really changes nothing about how our state operates now, but it does place fear and limitation on many more people than ever before. Please read up before you vote.

Marriage Needs Protection?

I am amused and mystified by the VoteForMarriage people whose key argument is that marriage must be protected. I often wonder FROM WHAT?

Let's make gay marriage completely legal for a minute. Do they think that thousands of people would suddenly abandon straight marriage, and the human race as we know it would be in jeopardy? Those dangerous, gay married couples would convince the rest of us that somehow marriage must be defined differently?

The logic is ridiculous. Really, just how does my neighbor's gay marriage affect me in any way??? They justify their bigotry. In fact, life, love and marriage would pretty much go on as normal, but we would really mean it when we say people have the right to pursue life, liberty and happiness.

I am a straight woman who is horrified by this move by the Right to entrench and enshrine prejudice. We will look back on 2012 in 60 or 70 years and be ashamed just as we look back on Jim Crow and feel ashamed. (And I don't blame God; I blame us.)

I am extremely saddened by this Amendment, having been raised in North Carolina and now live up North. What has happened to my State, that this level of bigotry has become so rampant? Christianity has been hijacked by those who judge and hate, instead of heeding the peaceful loving deity that I know. Gay marriage is legal in the state I currently live in and so far, no one has suffered because of it. Straight people still marry and divorce and survive in this "hedonistic" society. No one suffers, the children live on, the world still revolves. Judgment is in God's hands, and no one that I know, or you know, has the ear of God. The Bible is a well-meaning document written and re-written by MAN, the Old Testament 4000+ years old, the New Testament 2000 years old. It has been called upon to tell us that slavery is okay, war is okay, Jim Crow was acceptable, interracial marriages were wrong, and the subjugation of women was God's plan. All of these things have been cast aside and our society is the better for it. Gay marriage is another expression of love and life that will, one day, be considered "normal" and par for the course and people will forget that, one day, in the past, people were railing against the fight for civil rights, once again, and using God's name to judge others, without evidence that it was God's plan all along. The longer we pull God's name into our government, the more we create strife. Our government was designed to be secular for this very reason, so that no one religion designed our path, but that all paths were created equal. When will we learn? Will we become a religious society like Islam, killing in the name of God once again? It's time to put aside our intolerance and judgment and live as we would like others to live, and not parse out civil rights and happiness as we see fit.
